A Brazilian iPhone 12 user wins a lawsuit and Apple needs to provide it with a free charger

Apple has cancelled the included charger in the iPhone 12 series. The official explanation is for environmental protection. However, in March of this year, Procon-SP, the Brazilian public consumer protection agency, imposed a fine of 10,546,442.48 Brazilian reals on Apple. The agency believes that the charger is an indispensable component of mobile phones, and the failure to provide a charger means that it violates Brazilian consumer regulations.

Recently, Apple lost a lawsuit in Brazil because there was no charger in the box of the iPhone is sold. Brazilian user Mariana Morales Oliveira from Santos (São Paulo) sued Apple for this and eventually won, obtaining the right to obtain charger accessories for her iPhone 12 in court.

This is the first case in the State of Sao Paulo where Apple lost a case for failing to provide a charger. This obviously sets a precedent for all buyers who are dissatisfied with the iPhone 12 without a charger. Mariana’s lawyer Rafael Quaresma explained that the case is part of a “bundled sale”.

The customer bought a smartphone because it did not come with a charger. Therefore, the customer must purchase the accessory separately from Apple. He added that the argument for protecting the environment is not valid because the company did not stop selling or producing the product, but decided to sell it separately from the mobile phone.

“Only the charger that comes with the smartphone will pollute the environment? Stand-alone charger Wouldn’t it?” Apple was sentenced to provide consumers with a charger for free on the 10th. If the company fails to comply, it will be fined 200 reais per day, with a fine of up to 5000 reais.
