Unsatisfied with App Store terms, French Ministry of Finance sues Apple

Apple sued the French Ministry of Finance, it believes Apple’s App Store in the sale of software abuse by the terms of the agreement on September 17 on the case, a French court will be hearing.

The case is heard by the Commercial Court of Paris. Judging from previous similar cases, even if Apple is found guilty, France is unlikely to punish Apple severely. However, the court may require Apple to modify the terms of the App Store agreement. An Apple spokesperson declined to comment.

For the past 3 years, the French Directorate-General for Competition, Consumer and Anti-Fraud (DGCCRF) has been investigating Apple, and today’s decision is in the same line as the above-mentioned investigation.

In France, the law allows the Ministry of Finance to sue the company if it is found that a company has abused its power in the clause. France Digitale, France’s most famous startup lobbying group, will also participate in this case.

Nicolas Brien, CEO of France Digitale, believes: “We are all winners regardless of the outcome. If a commercial court convicts Apple, it is of course unprecedented… If Apple escapes by chance, it means that the current law cannot Supervise systemic platforms like Apple.”
